SMS Terms and Conditions

These SMS Terms and Conditions govern your use of SMS and TEXT message communications with Prosperity Immigration Law (“the Firm”). By providing your mobile phone number and consenting to receive text messages, you agree to the terms below.

1. Consent to Receive SMS / TEXT Messages

By providing your mobile phone number and consenting to receive text messages — through our website contact form, a signed engagement agreement, verbal consent during a consultation, or by texting START — you agree to receive SMS and TEXT messages from Prosperity Immigration Law related to your case, appointments, document requests, deadlines, and other matters directly related to your legal services.

2. Terms of Consent

Your consent to receive SMS/TEXT messages from Prosperity Immigration Law:

  • Is voluntary. You are not required to provide consent as a condition of retaining legal services.
  • Is specific to Prosperity Immigration Law only. Your consent will not be transferred to or shared with any third party for their own messaging programs.
  • May be revoked at any time by replying STOP or contacting us directly (see Section 6 below).
  • Covers transactional communications only — we do not send marketing or promotional SMS messages.

You may receive TEXT and SMS messages regarding:

  • Appointment reminders and scheduling confirmations
  • Case status updates and document requests
  • Deadline reminders for your immigration matter
  • Responses to inquiries you have submitted
  • Administrative and billing communications

We do not send marketing or promotional SMS or TEXT messages. All communications are transactional and directly related to your legal matter.

Message frequency varies based on case activity and may include appointment reminders, case updates, document requests, and deadline alerts. Standard message and data rates may apply.

Msg & data rates may apply. Standard message and data rates charged by your mobile carrier may apply to SMS messages you send and receive. Prosperity Immigration Law does not charge a fee for SMS communications. Contact your mobile carrier for details regarding your messaging plan.

Your SMS consent may be provided by:

  • Completing our online contact or intake form with SMS consent
  • Verbally consenting during a consultation or intake call
  • Signing an engagement agreement that includes SMS consent language
  • Texting START to our number

7. How to Opt Out / Revoke SMS Consent

You may revoke consent to receive TEXT messages at any time by:

Consent is limited to communications from Prosperity Immigration Law only. Prosperity Immigration Law will not share your mobile phone number or SMS consent with third parties or affiliates for marketing or any other purpose. Your information may be disclosed only:

  • To our SMS service provider solely for the purpose of delivering messages on our behalf, under strict confidentiality obligations

11. Record-Keeping & Compliance

Prosperity Immigration Law retains records of SMS consent (opt-in and opt-out) for a minimum of four (4) years in compliance with FCC regulations, TCPA requirements, and applicable carrier guidelines. Records include the date, time, and method by which consent was obtained and revoked.

12. Changes to These Terms

Prosperity Immigration Law reserves the right to modify these SMS Terms and Conditions at any time. Material changes will be reflected in an updated Effective Date at the top of this page and, where appropriate, communicated to active SMS subscribers. Continued use of our SMS program following any changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.

13. Disclaimers & Limitation of Liability

SMS and TEXT message communications are provided as a convenience for clients of Prosperity Immigration Law. The Firm does not guarantee the delivery, timeliness, or security of messages transmitted via third-party mobile networks. Prosperity Immigration Law is not responsible for delays or failures in SMS delivery caused by your mobile carrier, network outages, or factors outside our control.

To the fullest extent permitted by applicable law, Prosperity Immigration Law’s liability arising from SMS communications is limited to the correction or re-transmission of the affected message. Nothing in these terms limits liability for gross negligence, willful misconduct, or violations of applicable law.

SMS communications do not constitute legal advice and do not create or modify an attorney-client relationship unless a separate written engagement agreement is in place.
