Below are answers to the questions we hear most often, pulled from across our practice areas and organized by topic. If you do not see your question here, contact us and we will be glad to discuss your specific situation.

General Immigration

A visa allows temporary entry to the U.S. for a specific purpose and period. A green card grants lawful permanent residence, allowing you to live and work in the U.S. indefinitely. Green card holders may apply for citizenship after meeting eligibility requirements.

Work Visas

The H-1B is for specialty occupations and is subject to an annual cap and lottery. The O-1 is for individuals with extraordinary ability and has no cap. It also offers more flexibility for multiple employers or projects.

Green Cards and Permanent Residence

Yes, in limited cases like EB-1A and EB-2 NIW. These categories allow self-petitioning without an employer sponsor. Most other employment-based options require employer involvement.

Visitors, Students & Exchange Visitors

Most visitors are admitted for up to six months per visit. The exact period is listed on your I-94 record. Extensions must be filed before your stay expires.

DACA and Humanitarian Relief

Yes, renewals are currently being processed. USCIS recommends filing several months before expiration. First-time applications are not currently approved. (However, the law surrounding DACA is one of the most rapidly changing areas of immigration law. We will continue to keep our clients updated as developments are made.)

Victims of Crimes

A U visa is available to victims of certain crimes who have suffered substantial harm. Applicants must assist law enforcement in investigating or prosecuting the crime. It also provides a potential path to a green card.

Citizenship

Most people apply through naturalization after holding a green card for several years. You must meet residency, physical presence, and good moral character requirements. You will also need to pass an English and civics test.

Deportation Defense

Do not ignore it. An NTA means removal proceedings have started and you must appear in immigration court. Seek legal guidance as soon as possible to understand your options.
